The MrsCashBack Member Agreement sets forth the terms and conditions of your MrsCashBack membership. As a condition of membership, you must accept the agreement in its entirety; therefore, we encourage you to carefully review and familiarise yourself with it. In addition, you should review the agreement from time to time for any important changes. There are two different types of membership and the principle difference is that GOLD membership pays double the cashback of Standard membership at a cost displayed on the site. The current version of the MrsCashBack Member Agreement will always be available on the MrsCashBack web site.

Members cannot have multiple accounts. Any members found to have additional memberships will have their account suspended and any cashback will be lost.

Privacy Policy

We treat your privacy seriously. This Privacy Policy will explain how we collect and use your personal data and gives you the opportunity to limit our use of this information MrsCashBack.com (us, we, the company) collects personal information from users who subscribe/or enter free of charge to the website.

The purpose of collecting the information is threefold: firstly, to enable us to provide those who subscribe/enter free of charge with up to date information on news, special offers. Thirdly to ensure that whilst using the Cash Back part of our website, that your account is credited with the correct amount.

Consent for receiving promotional email transmissions can be withdrawn and the facility to do this will be displayed on the email transmission itself. Information such as "auto responses" or "system alerts" as well as "information only" transmissions will still be issued and these are important to be maintained whilst your membership continues.

MrsCashBack services may be featured in third party promotions and it is their responsibility to withdraw your details from future transmissions that they may issue should you wish to withdraw your consent. For example a third party company may send an email transmission to their email list, within which you are included. If you do not wish to receive any further information from THEM , then you will need to use their unsubscribe system. However, by withdrawing consent from THEM will not withdraw consent from MrsCashBack, this you will need to do as described in the paragraph above.

The arrangement shall be governed by English Law.

Terms of service MrsCashBack ("MrsCashBack") and all of its services (the "Service") are governed under this member agreement (the "Agreement").

You must login to MrsCashBack to participate in this Service. In order to open a MrsCashBack membership account, you must be invited within a marketing campaign, or sign up on-line, or via TEXT message then read and agree to the terms and conditions of the Agreement. Any person that signs up for the Service and agrees to abide by the terms of the Agreement is referred to herein as a "Member". By using the services and links provided on this site, it is therefore determined that you have accepted the terms and conditions contained.

MrsCashBack reserves the right, at any time, to:

(i) Change the terms of this Agreement,
(ii) Change or discontinue the Service, whether temporarily or permanently, including any content or feature of the Service, restricting the hours of availability or limiting the amount of use permitted by the Member, or
(iii) Change any fees or charges for use of the Service, including instituting new fees or charges for the use of the Service or any feature thereof.

Notice of any changes to this Agreement will be posted on the Site. Members will be given a minimum of thirty (30) days notice prior to any fees or charges becoming effective. All other changes shall be effective immediately upon notice. MrsCashBack is not responsible if you do not receive notice of such changes to the Service. Any use of the Service under a Member’s Account after such notice shall be deemed to constitute acceptance by the Member of the changes.

MrsCashBack reserves the right to terminate any accounts, and pay back any membership/subscription fee based on a pro-rata basis of the annual membership time frame at our own discretion and correspondence will not be entered into.

MrsCashBack reserves the right to terminate any account containing untruthful information and to prosecute individuals who deliberately provide false information in order to take advantage of any of the services.

Upon submission of a completed application and acceptance of the terms of the Agreement, you will be sent a password to activate your account. Your password is personal to you; you may not allow anyone else to use your password and you may not use anyone else’s password. You are responsible for keeping your password secret and changing in it to a password of your choice.

You agree to let MrsCashBack know of any unauthorised use of your password or any other suspected breach of security.

Membership is open to individuals that are of adult legal age pertaining to each country.

All members are responsible for complying with local regulations and Mrs CashBack assumes no liability in this respect.

MrsCashBack reserves the right to limit program enrollment at any time.

MrsCashBack reserves the right to transfer the membership agreement to a subsidiary of MrsCashBack. In this case members would be served by such subsidiary.

MrsCashBack reserves the right to cancel any membership if that member has been inactive for a period of 6 consecutive months i.e. has not logged in for 6 consecutive months and any accrued cashback will be forfeit.

MrsCashBack reserves the right to terminate membership without any further obligation to the Member in cases of abuse of Service rules and to take legal action in all such cases, including falsifying information or referrals, or if Member appears to be using the service in a manner inconsistent with this Agreement or the intent of the Service or any portion thereof, or who acts in a manner inconsistent with applicable laws, statutes or ordinances or if you use, or attempt to use, any part of the Service or the presentations for other purposes including, but not limited to, tampering, hacking, spoofing, using robots or scripts, copying, distributing, modifying, or otherwise corrupting the administration, security, or proper function of any part of the Service.

In the event of termination of membership, it is accepted that all funds in the members’ account will be transferred to MrsCashBack.

Members may terminate their membership at any time; however any annual subscription is non-refundable.

Any membership lasts no longer than 12 months. Upon expiry of membership it is at the members’ discretion to renew or not. However, a 30 day period will be made available to claim any cashback accrued by the member, provided that the funds are in excess of the minimum £30.00 requirement. During this time, the member may re-activate their membership and carry on their membership at the prevailing subscription fee at that time.

If the membership is left inactive or has NOT made a request to either withdraw funds or renew their membership after the 30 days has elapsed, then the membership will be cancelled and it is accepted that any funds left in the account will be automatically handed over to MrsCashBack. Funds cannot be transferred from one account to another.

It is the case that from time to time that new member cashback incentives or promotions will be introduced. These may include an initial contribution to the account opening of a new member. These incentives and promotions can be used in advertising campaigns linked to either certain publications or merchants that feature within the site. It is accepted that these incentives or promotions cannot be backdated to incorporate your membership. Where applicable; these incentives can be used in your regular account activity and can be drawn upon when the threshold has been reached in order to make a withdrawal. NB, A MrsCashBack cashback "bonus" is only applicable to Standard members. During Standard membership this can be withdrawn together with other funds provided that the applicable threshold has been reached, however "bonus" cash back is not transferable to Gold membership, therefore if upgrading, this the "bonus" introductory cash back value will be removed from your account. If Text messaging is used as a vehicle to communicate information, then is accepted that this has been used at your request (i.e. you need to text MrsCashBack first) any charges made for these communications are non-refundable.

When you recommend or refer a friend to the MrsCashBack.Com website and the individual registers; as the referrer you will now receive bonus cash back based upon any transaction that the new member(s) makes. You may refer as many individuals as you wish, however, if we receive complaints or find that this is being illegally marketed, then your membership will be terminated and all your accrued cash back will forfeited. You will only be notified of amounts that enter into your account and no other details will be given, nor conversation entered into concerning the transaction. You will be able to withdraw the amounts that have accrued by this scheme at the same time as when the referred to individual makes a withdrawal. However rare the occurrence, manually added transactions cannot be guaranteed to be entered into the scheme. We will not enter into discussion regarding untracked transactions with anyone other than the member who made the original transaction. Where an incentive or promotion has been employed eg £10.00 registration gift, then this is not eligible for bonus cash back. The new member will not have this 10% transferred away from them to subsidise the bonus cash back, they will enjoy the same benefits as you. Payment of the bonus will finish at the end of the lifetime of the free or STANDARD membership i.e. one year or when the new member upgrades to Gold membership.

Please be advised that a cash back payment is an enhancement of being a member of the MrsCashBack community and is not a guaranteed payment. In simple terms any payment made is at the discretion of MrsCashBack and not a mandatory payment. MrsCashBack will endeavor to convert the credits held in the members account into cash providing the "third party" merchant has passed the payment on to MrsCashBack and other commercial factors have bee processed such as correct tracking, legality, and meeting the minimum requirement fiscally and legally.

MrsCashBack credit to your account has no cash value until a withdrawal request has been approved by MrsCashBack and credit amounts are provided for guidance only. Credits are payable in pounds sterling (GBP). Most Partner Merchants (companies that you make an online transaction with through MrsCashBack) report transactions within a few days however some take up to sixty days to report transactions to us. This is to allow for items to be returned. If this is the case, then no credit will be issued. Where a partner Merchant has not acknowledged to MrsCashBack that a purchase has been made, MrsCashBack reserves the right to not allocate this credit to your account. In the event of software or hardware failure or failure of cookie based referral tracking, MrsCashBack does not accept any liability whatsoever. Should the situation arise that you are not credited with what you believe to be the case or not credited at all MrsCashBack will make all endeavour’s to obtain the credit amount from the Partner Merchant, however no guarantees can be made and MrsCashBack decision will be final. No correspondence will be entered into.

The member must advise MrsCashBack if they fail to see a credit appear upon their online statement within 30 days of the original transaction or within the time frame specified by the merchant. If this is the case we will take up the issue on your behalf with the Partner Merchant, but no guarantees can be made as to the recovery of such credit. If a transaction is subsequently identified as not being tracked in the normal manner and this is then added manually, then it is the case that in some instances only half of the expected amount will be given and this will be notified as soon as the information is given to us. Any offer or promotion displayed on the MrsCashBack site is governed by individual terms and MrsCashBack reserves the right to amend or remove any offer or promotion at any time without notice. In the event that a transaction linked to an offer is deemed by MrsCashBack to be incorrect due to error can be cancelled. In any cases of dispute, MrsCashBack decision will be final. All discounts excluding credits to your account are the responsibility of the respective partner merchant. Members should confirm the validity of any discount before entering into a transaction with the respective partner merchant. No discounts and offers can be used in conjunction with any other offer unless explicitly stated as this will invalidate any eligibility for credit.

Before a credit withdrawal can be processed, your account must have at least £30.00 in funds to be eligible for refund. MrsCashBack aims to fulfill credit withdrawal requests with seven to ten working days, however no guarantee is made, and no liability accepted should the process take longer. You are required to complete an online withdrawal request and all payments will be issued by cheque and sent in the post. A processing fee of £3.00 is made against all withdrawal claims and this will be deducted from the amount to be sent to you. Generally credits are available to be withdrawn 60 days after the transaction occurs and is determined by the Merchant Partner. In the event of a holiday purchase, this refund will be only available after the departure date of your holiday has elapsed, again please view the individual details of the Merchant Partner.

You are required to acknowledge that errors may occur within the payment of credit to you; however unforeseeable. Withdrawals of miscalculated amounts whereby the amount is in excess of what would be reasonably calculated will be treated as attempted theft and will be treated as such. This will include the immediate forfeiture of the amount being claimed, expulsion from the membership and loss of any paid up membership subscription.

If you return goods for any reason, including faulty goods, unless otherwise explicitly stated, then you are not eligible for credit withdrawal by you. If the amount is shown on your statement to be withdrawn, and you are aware that this is no longer available to you, you must ensure that you notify MrsCashBack as soon as possible. You are not permitted to request a withdrawal of these amounts even if the system allows you to do so. Should you withdraw this amount knowing that you are not eligible for this amount will be construed as fraud. All available methods including legal action will be taken to recover this amount together with any recovery charges or losses sustained as a result.

In the event of closure of the site MrsCashBack will make every attempt to pay any credit outstanding greater than the minimum withdrawal amount less any promotional deposit that may have been deposited in your account opening. All other credits will be lost. In the event that your membership expires before you have made a withdrawal, then any cash in your account become ineligible to be withdrawn as it cannot be rolled into a new account opening. Therefore it is in your interest to renew your account BEFORE it expires.

The "Cash Back Catcher" device will identify websites that you may visit independently of the MrsCashBack.com site that may be eligible to give you Cashback. However unlikely we cannot guarantee its effectiveness at all times nor accept any adverse effects that may occur within all browsers or PCs.

DISCLAIMER OF WARRANTIES

Members expressly agree that use of the Service is at the member’s sole risk. The Service is provided on a strictly "as is" and "available" basis.

MrsCashBack MAKES NO WARRANTY WITH REGARD TO ANY PRODUCTS, SERVICES OR REWARDS OBTAINED BY MEMBERS THROUGH THE SERVICE OR THROUGH SERVICE ADVERTISERS OR PARTNERS; THAT THE SERVICE WILL MEET MEMBER’S REQUIREMENTS; OR THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, ERROR FREE; NOR DOES MRSCASHBACK MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICE.

You understand and agree that any material and/or data downloaded or otherwise obtained through or from the Service is at your own discretion and risk, and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of such material and/or data.

The Service shall not be liable or responsible for those guarantees, warranties and representations, if any, offered by Service advertisers, partners, vendors, manufacturers of merchandise or suppliers of services. No advice or information, whether written or oral, obtained by Members from MrsCashBack or through the Service shall create any warranty not expressly made herein.

Notwithstanding these precautions, however, there are certain conditions that exist on the Internet generally which are outside MrsCashBack control and could result in a breach of security.

Accordingly, MrsCashBack cannot guarantee that your confidential information will be free from corruption or piracy. You hereby expressly waive any claim against MrsCashBack arising out of the loss of data through corruption, piracy, breach of security or for any other reason.

Member’s correspondence with or participation in promotions of the Service advertisers, partners and vendors are solely between corresponding Members and the service provider, partner merchant.

MrsCashBack assumes no liability, obligation or responsibility for any part of any such correspondence or promotion. If you do release your personal information to a third party, MrsCashBack will not be responsible for any adverse consequences that may result there from.

Decisions to make any purchases through any partner merchant featured within this site should not be based upon the value of the cash back offered. Once you have entered into a contract with a retailer by making a purchase you will be bound by their own terms and conditions and you should make yourself aware of these before hand. Should your transaction go "untracked" this will not be accepted by the retailer as a reason to cancel your transaction.

Members agree to indemnify and hold MrsCashBack, officers, employees and directors harmless from any claim, demand, expense or damage, including reasonable solicitors’ fees relating to the use of the Service or violation of this agreement.

If a message forum is introduced to the MrsCashBack site you take full responsibility for the content you post. If you post defamatory or other illegal content you will be held personally responsible for publishing such material. MrsCashBack.com does not want its users caught up in costly legal actions so please ensure you abide by these guidelines! The company disclaims all responsibility for publishing content in the Message Forum. Defamatory or other unlawful content will be removed from the site by an authorised moderator.
